I bought a "buy it now" scope on Ebay for a very nice price. I paid
immediately via paypal. I got an e-mail from the seller saying he'd
received the payment, and would ship within a day or two. Then I
got a shipping notice from FedEx, saying a shipment was being
arranged.
Then I got another e-mail from the seller saying he'd mistakenly
set the buy it now too low, and unless I pay another $60 he won't
ship it. (He did offer to refund the money alrealy paid.) I do have to
say I didn't like the tone of the e-mail. He essentially stated it was
either pony up the extra bucks, or give up the scope.
Well, here's the final outcome. It should come as no surprise. I filed
complaints with Ebay for his not honoring the contract, and for
threatening bad feedback if I gave him any. Both against Ebay's
poilcies. He essentially laughed it off when I said I was forced to
take it to Ebay, and he was right. They gave him a warning. No
sanctions, no account suspension. Just told him, "You're a naughty boy.
Now stop it."
I left him the negative feedback anyway because I think buyers have the
right to know this gentleman will simply refuse to honor any deal he
doesn't like. And since I have no intention of ever using Ebay again.
The initial email I got from Ebay asking for more information was a
hint of their true priorities. They said they considered his asking for
more money after the auction a serious offense, because they considered
it an attempt to "circumvent their fees."
I have a friend/coworker who sold someone some headlights, and the
seller said they arrived broken and demanded a refund. My friend said
that they were shipped intact, and therefore the shipping insurance
would pay the refund value. HIS account was suspended until he paid the
refund. But then, he is only an occasional seller. Ebay isn't making
lots of "fees" off him.
Ebay doesn't protect the little buyer - their concern is keeping the
big sellers selling, and the fees coming in. So to anyone who cares, I
give the advice to NOT expect Ebay to protect your interests, even when
you are 100% in the right.
For those who have had good dealings with telescope warehouse, I'm glad
for you. Those who have never dealt with Mr. Vorce, I can't recommend

Here is my correspondence with Bill Vorce, copied verbatim, over this
issue. In his negative feedback, he claimed he offered me the sun and
moon to satisfy me. As anyone can clearly see, that is a flat lie. I
have demanded that Ebay remove my negative. (Note: His emails have his
signature line at the end. Ones without that signature are my replies,
except for the final email, which he sent through Ebay to my ebay
account.) They are all in chronological order.

the buy it now price is $99.95 as stated in the text
but i put 39.95 on the price so i will need another $60
to ship this to you or i can send a full refund right now.

I've given this some thought now, and consulted others on
sci.astro.amateur, and here's what I've come up with. Legally, per Ebay
rules and contract law, you cannot contact me and state that you
require more than the agreed upon amount. However, I can understand the
price could be a mistake. So we can go one of two ways. I'll leave the
choice to you.
1) We can leave the transaction as is, you ship me the scope.
2) You can refund me the money ON CONDITION that you accept my negative
feedback for the incident, in which I will simply state that you didn't
honor the terms of the buy it now price, AND do NOT leave me negative
feedback.
Also, I'd request that in the future that you don't advertise a $100
price on a $110 scope as a huge savings. It is not. And put the text
about the $100 reserve on top of the ad, not below the scroll line. I
didn't see that due to it's position on the page. I simply saw it was
new in box, $50 shipped and that you had good ratings. I hit buy it now
right there.
Let me know your choice.
